A pawnshop is a microfinance organization: it grants individuals non-purpose microloans for up to one year, secured by a pledge of movable property intended for personal use.
(Article 1, subparagraph 5) and Article 3, paragraph 1, subparagraph 2) of the Law of the Republic of Kazakhstan “On Microfinance Activities”)

2. What you can do on this website

The pawnshop does not sell goods or provide services through this website. A microloan can only be taken out in person at our office: the pledged item is handed over to the pawnshop, inspected and valued in the borrower’s presence, the borrower’s identity document is checked, and the agreement (pawn ticket) is signed. A pledge cannot be accepted remotely, so nothing can be ordered or bought on this website.

The only thing you can do here is pay the debt under an existing agreement — principal, interest and penalty — through the Kassa24 payment service.

A pawnshop is prohibited from any other business activity not provided for by law. (Article 3, paragraph 6 of the Law of the Republic of Kazakhstan “On Microfinance Activities”)

3. Paying online under an agreement

Your payment is credited to the agreement (pawn ticket) whose number you entered when paying.

You may repay the microloan early, in full or in part. (Article 9, paragraph 1, subparagraph 4) of the Law of the Republic of Kazakhstan “On Microfinance Activities”)

When you repay early, interest is charged only for the actual number of days you used the microloan. (Article 4, paragraph 3, subparagraph 4) of the same Law)

Paying your debt is the performance of your obligation under a loan agreement, not the purchase of goods or a service. The rules on “returning a purchase” therefore do not apply to such a payment. Money is refunded if the payment was made by mistake (section 4).

After full repayment, the pledged item is handed back only at our office, to the borrower in person (or to a representative holding a notarized power of attorney), against a return certificate.

4. Refund of a mistaken payment

We refund the money if:

the payment was made to someone else’s or a wrong agreement number;

the amount paid exceeds the entire debt under the agreement (overpayment);

the card was charged twice, or charged because of a technical failure;

the payment was made to an agreement that is already closed.

How to apply. Visit our office or email the pawnshop. Please state:

the payer’s full name and IIN;

the agreement number, and the date, time and amount of the payment;

the Kassa24 transaction number from the receipt and the last 4 digits of the card;

the reason for the refund and an address (postal or email) for our reply.

An application without the full name and IIN, without a reply address, or filed by an unauthorized person may be left without consideration. (Article 17, paragraph 4 of the Law of the Republic of Kazakhstan “On Microfinance Activities”)

Time limits. We review the application and reply on the merits within 15 working days of receiving it. If the circumstances need to be clarified, this may be extended by another 15 working days; we will notify you of the extension within 3 working days. (Article 17, paragraphs 2–3 of the same Law)

Where the money goes. A card payment made through Kassa24 is refunded to the same card within 5 working days of the refund decision. The time it takes to reach the card depends on the issuing bank and is usually up to 30 calendar days. At the cardholder’s request, an overpayment may instead be applied to future payments under their agreement.

A mistakenly paid amount is not counted as repayment and does not reduce the debt under the agreement.

5. Goods: returns and exchanges

The pawnshop sells unredeemed pledged items only at its office, not through this website. A cash receipt and a delivery note are issued with every purchase.

A non-food item of proper quality may be exchanged or returned within 14 calendar days of purchase if it has not been used and its presentation, consumer properties, seals and labels, as well as the proof of purchase, are preserved. Exchanges and returns are made at the place of purchase — our office. (Articles 14 and 30 of the Law of the Republic of Kazakhstan “On Consumer Protection”)

If the item turns out to be defective, you may demand a replacement or a refund as provided by Articles 15 and 30 of the same Law.

Money for a returned item is paid back the same way the item was paid for: in cash at the cash desk, or as a refund to the card through the POS terminal.

Items bought in installments (under a microloan agreement) cannot be returned under these rules; the relationship is governed by the microloan agreement.

We give a reasoned reply to a written complaint about the quality of an item within 10 calendar days. (Article 42-4, paragraph 2 of the Law of the Republic of Kazakhstan “On Consumer Protection”)

6. If you disagree with our reply

On microloans and payments — the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market (ARDFM): finreg.kz.

On the quality of a purchased item — the authorized consumer protection body: Committee for Consumer Protection. (Article 33-2 of the Law of the Republic of Kazakhstan “On Consumer Protection”)

The courts — in the manner established by the laws of the Republic of Kazakhstan.

7. Legislation

Law of the Republic of Kazakhstan No. 56-V of 26 November 2012 “On Microfinance Activities” — Articles 1, 3, 4, 9, 17.

Consumer rights in financial services are set by special laws (Article 2, paragraph 2 of the Law “On Consumer Protection”). Loans and payments on them are therefore governed by the Law “On Microfinance Activities”, and purchased goods by the Law “On Consumer Protection”.
